GENERAL TERMS AND CONDITIONS (GTC)

In case of discrepancies between language versions, the German version shall prevail.

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between Creative Glass MHS AG, Geerenstrasse 13, 8604 Volketswil, Switzerland (hereinafter “Creative Glass”, “we” or “us”) and its customers (private and business customers).

1.2 These GTC apply to orders placed via the online shop, in-store, by telephone, e-mail, WhatsApp or any other communication channel.

1.3 Any terms and conditions of the customer shall not apply unless expressly confirmed in writing by Creative Glass.

2. Offer and conclusion of contract

2.1 The presentation of products and services in the online shop does not constitute a legally binding offer, but an invitation to place an order.

2.2 An automatically generated order confirmation merely confirms receipt of the order and does not constitute acceptance.

2.3 The contract is concluded only when Creative Glass expressly accepts the order, in particular by dispatch confirmation, handover of the goods, an explicit order confirmation, or delivery.

2.4 Creative Glass reserves the right to reject orders in whole or in part, in particular in the event of non-availability of goods, obvious pricing errors, or incorrect stock information.

3. Prices

3.1 All prices are stated in Swiss Francs (CHF), net, ex warehouse Volketswil, excluding statutory value added tax (VAT), unless expressly stated otherwise.

3.2 Price changes, product range changes and errors are reserved.

3.3 Rounding differences of up to CHF 0.20 are possible.

3.4 The minimum order value is CHF 30.–.

4. Shipping and delivery

4.1 Shipping and packaging costs (postage & packaging) are shown separately.

4.1.1 In exceptional cases, in particular for bulky, heavy or fragile items as well as for deliveries abroad, the actual packaging and freight costs may differ from the amounts displayed in the online shop.

4.1.2 In such cases, the customer will be informed before the goods are dispatched. If no consent is given, Creative Glass is entitled to withdraw from the contract or to cancel the affected items.

4.2 Orders with a total weight of more than 100 kg will be shipped by freight forwarder. An advance payment of CHF 100.– will be charged. The actual transport costs will be calculated subsequently.

4.3 Delivery times are non-binding. Delivery delays do not entitle the customer to damages or to withdraw from the contract.

4.4 Risk and benefit pass to the customer upon handover of the goods to the carrier or upon notification that the goods are ready for collection.

5. Availability and partial deliveries

5.1 Stock information shown in the online shop is non-binding.

5.2 If an order cannot be fulfilled in whole or in part, Creative Glass is entitled to make partial deliveries or to cancel items that cannot be supplied.

5.3 Payments already made for items that cannot be supplied will be refunded.

6. Payment terms

6.1 Accepted means of payment include in particular credit cards, TWINT, PayPal and other payment methods offered in the online shop.

6.2 Delivery against invoice (payment term 10 days) is possible up to an order value of CHF 300.–. Creative Glass reserves the right to deliver only against advance payment in whole or in part, in particular for new customers.

6.3 To protect our credit risk, we reserve the right to conduct credit checks.

7. Payment service providers and refunds

7.1 Payments made via external payment service providers (e.g. credit card, PayPal, TWINT) may incur fees which are not refunded to Creative Glass, or only partially refunded, in the event of a refund.

8. Right of withdrawal (voluntary)

8.1 Creative Glass grants a voluntary right of withdrawal of 7 calendar days from receipt of the goods.

8.2 Returns are at the customer’s cost and risk.

8.3 The goods must be returned complete, unused, undamaged and in the original packaging.

8.4 The right of withdrawal does not apply in particular to books, templates and specially marked products.

9. Warranty and liability

9.1 The statutory warranty in accordance with Swiss law (Swiss Code of Obligations, CO) applies.

9.2 Excluded are minor deviations, normal wear and tear, and damage resulting from improper use.

9.3 Liability for indirect damages, consequential damages and loss of profit is excluded to the extent permitted by law.

10. Retention of title and intellectual property

10.1 The goods remain the property of Creative Glass MHS AG until full payment has been received.

10.2 All rights to content, texts, images, templates and trademarks remain with Creative Glass MHS AG. Any use beyond private, non-commercial purposes is prohibited without prior written consent.

11. Courses and seminars

11.1 Separate course terms and conditions apply in addition for bookings of courses, seminars and events.

11.2 The applicable course terms form an integral part of the contract.

12. Data protection

12.1 Personal data is processed in accordance with our privacy policy.

13. International deliveries

13.1 Deliveries are generally made ex Switzerland.

13.2 For deliveries abroad, customs duties, import taxes (e.g. import VAT) or other official charges may apply. These costs are not included in the purchase price and are fully borne by the customer.

13.3 Customers domiciled outside Switzerland do not have a statutory right of withdrawal. Any voluntary right of withdrawal is granted exclusively in accordance with these GTC.

13.4 Returns from abroad are at the customer’s cost and risk. Returns must be adequately packaged and correctly declared. Unfranked or incorrectly addressed or declared returns will not be accepted.

13.5 Delays due to customs clearance, border controls or foreign carriers are outside our control and do not entitle the customer to damages or to withdraw from the contract.

13.6 Payments from abroad may incur additional fees (e.g. foreign currency or international fees). Such fees will not be refunded in the event of a refund if they were effectively charged to us.

14. Applicable law and place of jurisdiction

14.1 Swiss law shall apply exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

14.2 Place of performance and exclusive place of jurisdiction is Volketswil/ZH, Switzerland.
